If you've enjoyed hemp-derived THC edibles over the last few years, the rules are about to change in a big way.
In November 2025, Congress passed a law that redefines "hemp" at the federal level. Starting this fall, any hemp product with more than 0.4 milligrams of total THC per container no longer counts as hemp.
To put that in perspective, a typical hemp gummy has 5–10mg of THC per piece. Under the new limit, an entire jar would have to contain less than half a milligram. For most adults, that's not enough to feel anything at all.
The two dates that matter
- November 12, 2026: Products made with converted or lab-made cannabinoids, such as delta-8, delta-10, HHC and THC-O, lose hemp status.
- December 11, 2026: The 0.4mg per-container cap takes effect for naturally derived cannabinoids, including hemp-derived delta-9 THC. This date was pushed back one month in September 2026, and the White House has signaled there won't be another extension.
What this means for you
After these dates, the full-strength hemp edibles you know today can no longer be legally sold as hemp at the federal level. Some states are moving even faster with their own rules.

If there are products you rely on, now is the time to buy them while they're still legal to sell. Check your state's laws, store edibles somewhere cool, dark and airtight, and pay attention to best-by dates.
