Hemp THC Ban FAQ: Your Questions Answered (2026)
The federal hemp THC rules are changing this fall, and we've been getting a lot of questions. Here are straight answers to the most common ones. (For the full timeline, start here.)
When does the hemp THC ban take effect? There are two dates. On November 12, 2026, products made with converted or lab-made cannabinoids (delta-8, delta-10, HHC, THC-O) lose hemp status. On December 11, 2026, the 0.4mg-per-container cap takes effect for naturally derived cannabinoids, including hemp-derived delta-9 THC.
What is the new limit? 0.4 milligrams of total THC per container. That's the whole package, not per serving. A single standard edible usually has 5–10mg. (Here's how that compares.)
Does "total THC" include THCA? Yes. The new definition counts total THC, including THCA, not just delta-9.
Will the deadline be delayed again? It was already pushed back once, from November 12 to December 11. The White House has said it won't support another extension. Some bills in Congress propose delaying, repealing or regulating the change, but none have passed. Plan around December 11.
Can stores sell off leftover inventory after the deadline? The law doesn't include a sell-through window. After the effective date, products over the limit can't be sold as hemp.
Is CBD affected? Products that stay under 0.4mg of total THC per container still count as hemp. Many full-spectrum CBD products contain enough trace THC to go over that limit, so some CBD products will be affected too.
What about dispensary cannabis? Licensed dispensary products are governed by state marijuana laws, not the federal hemp definition, so they aren't affected by this change.
Can I still order hemp THC edibles online? Yes, until the deadline that applies to the product. After that, over-limit products can't be sold or shipped as hemp. Some states are ending sales even earlier under their own laws.
Is it legal to keep what I've already bought? Once the new definition takes effect, products over the limit are no longer hemp under federal law. How that applies to personal possession depends on where you live, so check your state's rules.
Does my state have its own rules? Many do, and some are stricter or start sooner than the federal dates. Always check your state's current law.
